The Petitioner, a senior citizen aged about 72 years, is a practising Advocate in Karkardooma Courts. He is the owner of property bearing no. H. No. 395-A, Gali No. 7, West Kanti Nagar, Delhi - 1100511. Respondent No. 2 is the Petitioner's son. The Petitioner's allegations are that Respondent No. 2 has been harassing him and his family members with the intent to grab the subject property which is the Petitioner's self-acquired property. 2.

In this regard, the Petitioner submits that he had also filed an application under the Delhi Maintenance and Welfare of Parents and Senior Citizens (Amendment) Rules, 20162 seeking eviction of his son - Respondent No. 2 from the subject property.

In the said proceedings, the District Magistrate, vide order dated 10th March, 2025 has directed Respondent No. 2 to vacate the subject property within a period of 30 days.

The Petitioner alleges that once Respondent No. 2 became aware of the order of eviction against him, he mercilessly beat him. In this regard, the Petitioner also made a police compliant dated 19th March, 2025 to the SHO, P.S. Krishna Nagar.

Further, the Petitioner submits that on 21st March, 2025, Respondent No. 2 locked him up in a room and once again mercilessly beat him with fists and blows. The Petitioner again filed a police compliant with the SHO, P.S. Krishna Nagar, on the same day. However, despite the aforesaid complaints, no action has been taken. Therefore, being fearful of a threat to his life and safety, the Petitioner has filed the instant writ petition seeking protection from the police.

The Court has considered the submissions of the Petitioner. Since, Respondent No. 2 is not present before the Court, the Court refrains from making any comment on the allegations made in the present petition. However, considering the fact that the Petitioner has already filed two complaints with the SHO, P.S. Krishna Nagar, narrating the incidents of assault on him, it is considered appropriate to issue the following directions: (a).

The SHO of the concerned Police Station shall provide adequate protection to the Petitioner and the beat constable of the concerned area shall be sensitized in this behalf.

(b).

The telephone numbers of the concerned Police Station as well as of the beat constable shall also be provided to the Petitioner in order to enable him to contact the officers, in the event of any threat or apprehension. (c). Action, if any on the complaints submitted by the Petitioner, be taken in accordance with law.

Accordingly, with the above directions, the present writ petition is disposed of along with pending application.
