The present petition has been filed under Article 227 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) seeking direction for the learned Trial Court to complete the testimony of the witness in a period of four weeks from the next date of hearing i.e. 07.04.2025 in FIR No. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. 78/2023 registered at PS Cyber Police Station (Outer) under Sections 384 Indian Panel Code, 1860, Section 67(A) Information Technology Act, 2000 and 4/12 POCSO Act (subject FIR).

The learned counsel for the petitioner submits that pursuant to the complaint by the victim/PW-1, subject FIR came to be registered on 26.10.2023. Whereafter, the Investigating Officer conducted the investigation and the petitioner was arrested on 28.10.2023. 5.

Learned counsel for the petitioner submits that the petitioner is in custody for the last 1 year 4 months and the testimony of the victim is yet not concluded and the victim had been seeking repeated adjournments and is deliberately delaying the trial, thus, the learned Trial Court be directed to complete the testimony of the victim within four weeks.

The learned Trial Court, i.e. the learned ASJ(SC-POCSO)-02, West District, Tis Hazari Courts, Delhi, is requested to expedite the recording of the evidence of PW-1/victim.

It is made clear that this Court has not expressed any opinion on the merits of the case.
