The petitioner impugns the order dated 02.08.2017 whereby the application of the petitioner under section 190 read with section 156(3) Cr.P.C. for a direction to the investigating agency to properly investigate the role of Ram Diya and his son Pradeep Singh was dismissed. The application was dismissed solely on the ground that the petitioner who is an accused could not maintain such an application.

Learned counsel for the petitioner submits that he has given certain documents to the investigating agency exposing the role of the said persons in the commission of the offence and showing that he is not the person who has committed the alleged offence. CRL.M.C.832/2018

Learned APP on instructions of the IO submits that the documents furnished by the petitioner are being examined and shall be taken into account during investigation and if culpability of any third party inter alia the person referred above is exposed, appropriate action in accordance with law will be taken.

In view of the above, the petition is disposed of reserving the liberty to the petitioner to once again approach the Trial Court in case the situation so warrants.
