1. The Hon'ble Court vide order dated 24.03.2026 has, inter alia, directed as under :- "....

2. There is no dispute that the appellant has agreed that the amount deposited by the appellant in this Court has to be released to the respondent. The counsel for the respondent states that the same could be after computing the amount in terms of the judgment passed by this court on .30.10.2025, modifying the impugned judgment decree dated 31.01.2024 of the learned District Judge (Commercial Court-10), Tis Hazari Courts, Delhi in CS Comm. 3436/21, in the following manner:- "31. Hence the judgment and decree shall be read as 'suit is decreed with costs for a sum of Rs.38,94,070/- along with interest at the rate if 9 percent per annum from filing of the suit till its recovery."

3. If that be so, appropriate shall be for the Registry to compute the amount, as is payable in terms of the judgment rendered by this Court on 30.10.2025. Based on the computation, learned Registrar General shall direct the release of the amount which shall satisfy the order dated 30.10.2025. The balance amount still remaining shall be returned to the appellant herein...."

calculations regarding the amount to be payable to the respondent in terms of the judgment dated 30.10.2025 passed by the Hon'ble Court, have been done by the Registrar (B&A) whereby an amount of Rs.47,98,081/- along with proportionate interest on the FDR is to be payable to the respondent and the balance principal amount along with proportionate interest is to be released to the appellant.

Learned counsel for the respondent submitted that the cost of Rs.49,856/- has not been included in the calculation sheet submitted by Registrar (B&A). He has placed on record his calculation sheet and sought to e-file the same in the registry. Let the same be done before the next date of hearing.

Upon filing of the aforesaid calculation sheet by learned counsel for the respondent, Registrar (B&A) is directed to calculate the total amount afresh by considering the cost factor as submitted above by learned counsel for the respondent and submit the fresh report before the next date of hearing.

In the meanwhile, since the aforesaid calculated amount of Rs.47,98,081/- is not disputed by either of the parties, Registrar (B&A) is directed to release the said amount to the respondent's bank account, the details of which have been mentioned in the cancelled cheque submitted with the application.
