% 05.05.2020 The petition has been heard through video conferencing. CRL.M.A. 5871/2020 (Exemption) Allowed subject to all just exceptions.

CRL.M.C. 1465/2020 This petition has been filed primarily assailing the Order dated 15.04.2020 passed by the learned ASJ-09 (POCSO) (West), Tis Hazari Court, Delhi, granting interim bail to the respondent no.2 for a period of one month.

The learned counsel for the respondent no.2, without prejudice to the rights and contentions of the respondent no.2, submits that the respondent no.2 shall surrender himself to custody on or before 4.00 PM on 08.05.2020. He submits that he would thereafter file an application seeking interim/regular bail before the learned Trial Court.

In view of the above statement and binding the respondent no.2 to the same, the present petition is disposed of. It is made clear that the respondent no.2 shall be free to file an application seeking interim/regular bail, which shall be considered by the Competent Court remaining uninfluenced by the observations made in the order dated 15.04.2020 impugned in the present petition. This order be also communicated to the concerned Jail Superintendent for ensuring compliance.
