O R D E R

Applicant seeks anticipatory bail in case arising out of FIR No.80004695/2026, registered at Karol Bagh/e-Police Station, under Section 305 of Bharatiya Nyaya Sanhita (BNS), 2023.

As per the allegations appearing in the FIR, one Mr. Bikas Mandal was employee of the complainant and he had, as per the allegations, misappropriated gold weighing 165.330 grams between 01.11.2025 and 18.11.2025.

Such employee and prime accused i.e. Bikas Mandal has already been arrested and is in judicial custody and during his disclosure, he had claimed that he had given some such misappropriated gold to his father. The applicant herein is his father who seeks anticipatory bail and submits that he had earlier joined the investigation also.

the learned Trial Court, it was noticed that the despite specific notice, he failed to join the investigation and the misappropriated gold from him was yet to be recovered and, therefore, the anticipatory bail was rejected. 5.

Learned APP for the State appears on advance notice alongwith the concerned I.O.

It is informed that the applicant lastly joined the investigation on 09.03.2026 and 10.03.2026 and he is, reportedly, residing in Medinipur District, West Bengal.

Learned counsel for the applicant submits that the applicant has no previous criminal record or antecedents of any nature whatsoever and he, if directed again, would join the investigation. 8.

The charge-sheet qua the son of the applicant would be, as informed, filed shortly.

Keeping in mind the overall facts and circumstances of the case, the present application is disposed of with direction that the applicant shall join the investigation, as and when so directed, and would fully assist the Investigating Agency. In the event of his arrest, the applicant be admitted to bail on his furnishing personal bond and surety bond in a sum of Rs. 25,000/-, subject to the satisfaction of the concerned SHO/IO/arresting officer. 10.

The notice, if any, be served upon the applicant well in advance as he is a resident of West Bengal. A copy thereof be also served upon his counsel. 11.

Needless to say, in case he fails to participate in the investigation, the prosecution would be at liberty to file appropriate application seeking cancellation of the abovesaid relief.
