This hearing has been done through hybrid mode. 2.

The present petition has been filed by the Petitioner under Article 226 of the Constitution of India, inter alia, seeking release of the amount of compensation in respect of the land in question being Khasra No. 58//16min(1-11) & 25min((1-4) situated at the revenue estate of Village Pooth Khurd, Delhi.

On 9th September, 2009, a notification was issued qua the land of the Petitioner under Section 4 of the Land Acquisition Act, 1894. The award being Award No.02/2012-13 has also been passed on 5th September, 2012. However, compensation has not been released to the Petitioner till date. Hence, the present petition.

the amount is liable to be paid to the Petitioner. The only reason given by the LAC is insufficiency of funds.

In the opinion of this Court, the same is not a sufficient ground to not pay the compensation to the Petitioner. Accordingly, let the compensation be released to the Petitioner within a period of four months from now. 6.

The petition along with pending applications, if any, is disposed of in above terms.
