The petitioner has filed the present petition, inter alia, seeking interim bail in FIR No. 0422/2017 under Section 376/354/506 IPC and under Section 4/6 of the Protection of Children from Sexual Offences Act (POCSO Act) registered with P.S. Mehrauli.

The petitioner claims that his wife is required to undergo a surgical operation and seeks interim bail for the purposes of attending to his wife. It is stated in the petition that his wife is staying alone and has been unable to secure necessary medical treatment on account of financial constraints. 3.

Mr Dutta, learned APP appearing for the State states that it has been telephonically verified from the concerned doctor that the petitioner's wife was admitted to the concerned hospital on two occasions for treatment but the surgery could not be performed due to financial constraints. 4.

In the given circumstances, this Court considers it apposite to allow the present petition. Accordingly, it is directed that the petitioner be released

on interim bail for a period of three weeks from the date of his release. This is subject to the petitioner furnishing a personal bond in the sum of ₹10,000/- with one surety of an equivalent amount to the satisfaction of the Jail Superintendent. The petitioner shall not leave the National Capital Territory of Delhi. He shall also provide a contact number and ensure that her is reachable at all times.
