After some arguments, Mr. Harsh Gokhale, who appears for the petitioner, concedes that the drawer of the cheque needs to be arrayed as a party to the present proceedings.

Therefore, Mr. Gokhale seeks liberty to withdraw the captioned petition with leave to file a fresh petition on the same cause of action after impleading the drawer of the cheque as a party to the present proceedings. 3.

The captioned writ petition is, accordingly, dismissed as withdrawn with liberty as prayed for.

If the petitioner approaches the Registry of this Court with a fresh petition sans the objection adverted to hereinabove, the same will be listed for hearing.
