Petitioner seeks quashing of order dated 07.01.2019 whereby petitioner has been declared as a Proclaimed Offender. 2.
Learned counsel for the petitioner submits that the petitioner was never served with the non-bailable warrants or any notice requiring him to appear before the trial court. Learned counsel further submits that the petitioner was availing his remedy and had approached the Sessions Court as also this Court for anticipatory bail so there was no question of avoiding any service. 3.
Learned counsel for the petitioner submits that the trial court was misled in passing the order dated 07.01.2019 and that the petitioner has since been arrested.

Accordingly, learned counsel for the petitioner seeks leave to CRL.REV.P. 379/2019
withdraw the petition with liberty to approach the trial court and raise all the pleas before it, while inter-alia, impugning order dated 07.01.2019 declaring him a Proclaimed Offender. 5.
In view of the above, the petition is dismissed as withdrawn with liberty to petitioner to approach the trial court seeking recall of order declaring the petitioner as a Proclaimed Offender. 6.
It is clarified that this Court has neither considered nor commented on the merits of the case. All the rights and contentions of parties are reserved.
