% 06.05.2020 This hearing has been conducted by video conferencing. The present petition under Section 9 of the Arbitration and Conciliation Act, 1996 was filed seeking extension of the Concessionaire Agreement dated 23rd June, 2005. The case of the Petitioner was that the Chief Engineer had recommended extension of the agreement by 1358 days, however the competent authority had not taken a decision in the matter. Hence a prayer for interim relief under Section 9 was made in the present petition.
Notice was issued in the petition on 1st May, 2020 and reply was called for today i.e.,6th May, 2020.
Mr. Jay Savla, ld. Senior Counsel and Ms. Maninder Acharya, ld. ASG have jointly reported to the court that the competent authority has extended the Concessionaire Agreement by 1170 days with effect from today i.e., 6th May, 2020. The Petitioner is satisfied with the said extension and accordingly does not press the present petition. Taking on record the statement made by ld. counsels for the parties, the petition is dismissed as not pressed. Respondent shall be bound by the statement recorded today. All pending IAs are disposed of.
