CRL.M.A. 7032/2020 (exemption from court fees)

CRL.M.(BAIL) 6435/2020

5. The hearing was conducted through video conferencing.

6. Issue notice. The learned Additional Public Prosecutor named above accepts notice on behalf of the State.

7. At joint request, the application is taken up for disposal.

8. The applicant was granted interim bail to attend to his wife who

has a medical condition in her spine. Her operation could not take place on the earlier date fixed i.e. 05.05.2020 as the appellant had not reached home in sufficient time. Meanwhile, she took ill. Now her operation has been re-scheduled now for 05.06.2020 at another hospital. According to the learned APP for the State these developments have been verified by the police. Evidently, the purpose for which the earlier bail of four weeks was granted, remains unserved. The petitioner's conduct in the said period has given no cause for complaint.

9. In view of the above, the time period of interim bail is extended by another four weeks, subject to the same terms and conditions on which interim bail was granted earlier.

10. The application is disposed-off in the above terms.

11. The order be uploaded on the website forthwith. Copy of the order be also forwarded to the counsels through email. NAJMI WAZIRI, J JUNE 02, 2020/AB
