This is a petition under section 528 of Bhartiya Nagarik Suraksha Sanhita (BNSS), 2023, read with section 482 of Criminal Procedure Code (Cr.P,C), 1973 seeking waiver/removal of furnishing the entire cheated amount of Rs.5,00,000/- in the account of the complainant vide order dated 12.02.2025 and read with order dated 20.02.2025 arising from the FIR no. 561/2024 U/s 318(4)/319/61(2) BNS registered at PS Special Cell. 2.
The perusal of the order dated 12.02.2025 reveals that the petitioner himself expressed his willingness to pay a sum of Rs.5 lakhs in the account of the complainant and on such statement, the learned Sessions Court issued directions that no coercive action be taken till the next date and on the next date i.e., 20.02.2025, the court was informed that the entire payment has The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. been made to the complainant and considering the same the learned Sessions Court granted anticipatory bail to the petitioner. 3.
Learned APP states that, in case, the amount is directed to be returned back to the petitioner, the petitioner must be relegated to the stage prior to the grant of anticipatory bail.

It is evident from both the aforesaid orders that it was the petitioner who himself made an offer to pay Rs.5 Lakhs to the complainant and the same was not a condition imposed by the learned Trial Court. 5.
At this stage, Ms. Pallavi Garg, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to approach the learned Trial Court for appropriate remedy. 6.
The statement made by the learned counsel appearing on behalf of the petitioner is taken on record.

In view of the statement made by the learned counsel appearing on behalf of the petitioner, the petition is dismissed as withdrawn with liberty as prayed for.
