The present petition has been taken up for hearing through video conferencing.

Crl.M.A. Nos.6029/2020, 6030/2020 (for exemption) 2.

Exemption allowed, subject to all just exceptions. The applications are disposed of.

BAIL APPLN. 825/2020 &Crl.M.(B)5874/2020 3.

The present petition under Section 439 of the Code of Criminal Procedure seeks regular bail in FIR No.30/2018 under Sections 302/201/120B of the IPC and Sections 25 and 27 of the Arms Act. 4.

The petitioner has also sought interim bail primarily on the ground that he has an ailing mother who is 75 years old and is suffering not only from hypertension and diabetes but is also required to undergo surgery for stones in her gall bladder. Mr.Abhijat, learned

counsel for the petitioner submits that though this Court vide its order dated 01.10.2019 was pleased to grant interim bail to the petitioner for attending to the surgery of his mother, which was scheduled for 05.10.2019, the same could not be held on account of high blood pressure of his mother. He, therefore, prays that the petitioner be granted interim bail to enable him to get a fresh date fixed for his mother's surgery.

Learned counsel for the respondent vehemently opposes the application and submits that the petitioner's prayer for interim bail cannot be considered till a date for his mother's surgery is fixed. He submits that there are many other adult members in the petitioner's family, who can take his mother to the hospital and get a date fixed for the surgery.

After some arguments, learned counsel for the petitioner seeks leave to withdraw the present application with liberty to approach the Court again once a date is fixed for the surgery of his mother. 7.

The application along with the all miscellaneous applications is dismissed as withdrawn with liberty as prayed for. 8.

It is however made clear that in case a fresh application for interim bail is moved by the petitioner, the same will be considered on its own merits.
