% 13.09.2025 Appellant insurance company has filed an appeal for reduction of the award dated 03.12.2024 passed by the Learned MACT, awarding a compensation of Rs. 84,64,592.6/- along with interest @ 9% p.a. from the date of filing of claim petition. We have interaction with the Ld. Counsel/Parties concerned, it is submitted by the Ld. Counsel for the Appellant and Respondent No. that Appellant shall not be pressing the appeal and Respondent(s)/Claimant(s) shall not be pressing the cross objection bearing no. 42799/2025 respectively.

In view of the settlement, Insurance company is directed to deposit the awarded amount i.e. Rs. 84,64,592.6/- along with interest @ 9% per annum from the date of claim petition till the date of deposit before the concerned Tribunal. The Insurance Company is permitted to deposit 50% award amount alongwith the accrued interest within a period of four weeks before the concerned Tribunal and balance 50% of the awarded amount alongwith accured interest shall be deposited by the Insuance Company before the concerned Tribunal within six weeks from today and on such deposit, concerned Tribunal is directed to release 50% of the awarded amount in favour of the Respondent No.
1/Claimant, subject to fulfillment of all the requisite formalities and balance 50% will be kept in the FDR of any nationalized bank alongwith the interest for 10 years and monthly interest accrued on the said FDR shall be paid to Respondent No.1. The Registrar General is directed to refund the statutory amount with the interest, if any, to the Insurance Company. In terms of the aforesaid, the present appeal along with pending application (s) stand disposed of with directions in terms of the settlement.
A copy of this order be sent to the concerned learned Tribunal with TCR, if already received.
