For the reasons stated in the application, the delay of 395 days in filing the petition is condoned. Application is disposed of. CM (M) 509/2019 & CM APPL. 14861/2019 (stay) 2.

There was a delay in the filing of the written statement. No condonation of delay application was filed and the right to file the written statement was closed by the Trial Court vide the impugned order dated 8th January, 2018. Thereafter, the application seeking condonation of delay in filing the written statement is also stated to have been dismissed. 3.

Ld. counsel for the parties do not dispute that the trial in the suit has concluded and the suit is at the stage of final arguments. 4.

Considering the stage of the suit, the written statement is directed to be taken on record, subject to payment of costs of Rs.10,000/- to be paid by the Petitioners to the Respondent, on or before the next date before the Trial

Court. The impugned order is, accordingly, set aside. 5.

The petition and all pending applications are disposed of in the above terms. Dasti.
