2.
Learned counsel for the Appellants submits that in terms of order dated 20.01.2025, a sum of Rs.1,51,666/- has been deposited by Appellants on 04.02.2025 and a sum of Rs.1,51,700/- has been deposited by way of demand draft today i.e., 05.03.2025 and the same be released to the Appellants.
3.
Since the inter se disputes have been amicably resolved between the parties and it is agreed that Appellants shall pay a total sum of Rs.1.25 crores to the Respondent within four weeks from today, appeals are disposed of in terms of the settlement, binding the parties thereto. As agreed, Appellants shall pay the amount within the time undertaken. Insofar as a sum of Rs.3,03,366/- is concerned, order dated 20.01.2025 reflects that the amount was deposited as part payment towards arrears of user charges due towards the Respondent in terms of impugned judgment and interim orders of this Court dated 01.04.2019 and 05.12.2019. Therefore, in my view, the said amount cannot be released to the Appellants. 4.
Registry is directed to release a sum of Rs.3,03,366/- in favour of the Respondent within four weeks from today.
5.
Respondent undertakes to withdraw the execution petition pending before the Executing Court on receipt of Rs.1.25 crores. Undertaking is accepted.
6.
Pending applications stand disposed of.
