Having heard the learned counsels for the parties present, and upon going through the record of the case, particularly the order dated 05.03.2025, the position that emerges is that the present appeal, instituted at the instance of the appellant, stands disposed of in terms of the amicable settlement reached between the parties. 3.

In summary, the appellants undertook to pay a sum of Rs. 1.25 crores to the respondent/Love Kumar Chopra within four weeks towards full and final settlement of all dues. The outcome of the aforesaid settlement is that the judgment and decree dated 31.08.2018, passed in favour of respondent, as well as the respondents right to seek possession of the suit premises, stands abandoned and waived. Further, the impugned sale deed which is in favour of the respondent No.1 shall be deem to have been cancelled.

Learned counsel for the appellant today in the Court has handed over five Demand Drafts, out of which three Demand Drafts are drawn on Yes Bank, Rajouri Garden, New Delhi, and other two Demand Drafts are drawn on Kotak Mahindra Bank, Connaught Place, New Delhi, the details of which are reflected in paragraph (07) of the present application. The same is accepted unconditionally on behalf of the learned counsel for respondent No.1.

However, a sum of Rs. 1,25,000/- appears to have been deducted towards TDS. Nonetheless, upon an objection being raised, it is undertaken by the learned counsel for the appellant that the said amount, i.e., Rs. 1,25,000/-, shall be further disbursed, either by etransfer or by handing over a Demand Draft, to respondent No.1 within seven days from today.

Subject to the payment of the aforesaid amount, the present application is disposed of with a direction that the registered Sale Deed, bearing document No. 117/15, in Addl. Book No.1, Volume No. 14820, on pages 126 to 130 dated 04.06.2007, shall be deemed to have been cancelled.
