This is a petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 challenging the order dated 25.03.2025 passed by the ASJ/Sessions Judge (NDPS), New Delhi, where the learned ASJ had directed the Superintendent, Safdarjung Hospital, to constitute a Medical Board and further directed the Medical Board to furnish its opinion within 15 days. 2.

Today, Mr. Arun Khatri, learned Senior Standing Counsel for the respondent-NCB hands over the Bench the response dated 04.06.2025 issued by the Senior Consultant, Institute of Liver, Gastroenterology and Pancreaticobillary Sciences Department of the Sir Ganga Ram Hospital. The same is taken on record.

According to the said response, particularly para 2, the present medical condition of the petitioner as on 04.06.2025 is stated to be "stable" after discharge on 28.05.2025. advised to continue oral medication after discharge. It further notes that the petitioner is suffering with acute necrotizing pancreatitis and the fact that the said ailment is curable with medicines. It has been reiterated again in the response that the petitioner's condition presently is stable and he is capable of taking care of himself and that there is no need for any support or care taker for him.

In that view of the matter, this Court is of the opinion that no further indulgence is required to be shown and the present petition is dismissed finding no merits in the matter.

Interim bail granted to the applicant is expiring today i.e. 06.06.2025. However, in view of the medical condition of the applicant/petitioner, this Court permits the applicant/petitioner to surrender tomorrow i.e. 07.06.2025 on the same terms and conditions as mentioned in order dated 02.04.2025.
