The hearing has been conducted through video conferencing. Crl. M.A. 6136/2020 (exemption).
Exemption is allowed, subject to all just exceptions. Bail Appl. No. 853/2020 1.
This is an application for grant of interim bail for a period of 30 days to the petitioner. Ld. Counsel for the petitioner has prayed for interim bail on the ground that father of the petitioner is suffering from enlarged prostate gland complication and is under treatment from N.C. Hospital, Sewak Park, Dwarka Mod, New Bail Appl. No. 853/2020 Page 1 of 3
Delhi. Ld. Counsel for the petitioner submits that the doctor has advised surgery, which is scheduled for 20.05.2020. 2.
It is submitted by Ld. Counsel for the petitioner that petitioner has deep roots in the society and he will surrender back in time after expiry of interim bail.

Ld. APP for the State has opposed the interim bail application on the ground that there are allegations of murder against the petitioner. Two witnesses have already turned hostile. There is an apprehension that petitioner may influence the witnesses. She, however, submits that still there is forensic evidence available on record that connects the petitioner with the alleged crime. However, she submits that it has been verified that the surgery of the father of the petitioner is due at N.C. Hospital, Sewak Park, Dwarka Mod, New Delhi.

I have considered the rival submissions. In view of the submissions made by Ld. Counsel for the petitioner and considering the fact that surgery of the father of the petitioner for enlarged prostate gland complication is due at N.C. Hospital, Sewak Park, Dwarka Mod, New Delhi for 20.05.2020, the petitioner is granted interim bail for a period of 15 days from the date of his release. Petitioner be, therefore, released on interim bail for 15 days, if not required in any other case and subject to his furnishing a personal bond in the sum of Rs. 25,000/- to the satisfaction of concerned Jail Superintendent, subject to the following conditions:- i.
The petitioner shall contact the concerned IO/SHO of P.S. Mahindra Park on every Bail Appl. No. 853/2020 Page 2 of 3
Monday during the period of release through video call and if the video call is not possible due to any reason, he can contact the above officers through audio call.
ii.
The petitioner shall not leave the jurisdiction of NCT of Delhi.
iii.
The petitioner shall surrender before the Jail Superintendent after the expiry of the period of interim bail of 15 days.
iv.
The petitioner shall not contact or try to influence any of the witnesses of the case directly or through anyone else.

The petition stands disposed of. A copy of this order be communicated to the concerned Jail Superintendent electronically. 6.
A copy of this order be uploaded on the website of this court forthwith.
