The present matter has been taken up through Video Conferencing. 2.

The petitioner has filed the present writ petition praying inter alia for issuance of a writ of habeas corpus against his wife/respondent No.2 on a plea that he is entitled to visitation right in respect of his two children. Further, the petitioner seeks a direction to the learned Family Court to dispose of the Guardianship petition filed by him against respondent No.2 in respect of the children.

At the outset, we have requested the petitioner, who appears in person, to address the Court on the maintainability of the first relief in the petition when he is well aware of the place where both the children are residing, i.e., with their mother at the Delhi Police Apartments, Mayur Vihar, Delhi. We have also requested the petitioner to address us on the second relief prayed for in a W.P (CRL) 793/2020

criminal writ petition filed by him when, the Family Court is admittedly seized of the matter and the next date fixed before it is 18.5.2020. 4.

At this stage, the petitioner states that he may be permitted with withdraw the present petition, while reserving his right to pursue the Guardianship petition filed by him before the Family Court. 5.

Leave as prayed for, is granted. The petition is disposed of along with the pending application.
