versus INSTITUTE OF HUMAN BEHAVIOUR & ALLIED SCIENCE (IBHAS) ..... Respondent Through:

CORAM:

HON'BLE MR. JUSTICE VIBHU BAKHRU

O R D E R

% 01.08.2019 1.

The petitioner has filed the present petition, inter alia, asserting that his daughter (hereafter 'KL') is suffering from mental illness/disease and due to his old age and financial crisis, he is unable to provide the requisite care and treatment to his daughter.

2.

In this regard, an application was filed by the petitioner's son before the learned Metropolitan Magistrate, seeking a direction that KL be admitted in the respondent hospital (IBHAS).

Pursuant to the said application, an order dated 15.02.2019 was passed by the learned MM, recommending KL be admitted to IBHAS.

3.

The petitioner claims that the officials from IBHAS have been contacting the petitioner to remove KL from the said hospital and are insisting on discharging her. It is his case that KL requires medical attention

and since he is not in a position to take care of her, IBHAS should be restrained from discharging her without providing the requisite treatment. 4.

The learned counsel appearing for IBHAS states that KL was admitted to the hospital but was released on 27.06.2019, in the presence of the IO as well as the petitioner. He further states that requisite treatment was provided to her and she is currently lodged in the Women's Home 'Nirmal Chhaya'.

He also states that if need arises for further treatment, IBHAS shall provide the same.

5.

In view of the above, no further orders are required to be passed in this petition.

The same is disposed of.

The pending application is also disposed of.
