The hearing has been conducted through video conferencing. 2.

This is an application for grant of interim bail to the petitioner. Ld. Counsel for the petitioner has prayed for interim bail on the ground that wife of the petitioner is suffering from severe vaginal bleeding and Endomet Polyp and the doctor has advised surgery.

Ld. APP for the State has filed the status report. As per status report there is no date fixed for surgery.

Ld. Counsel for the petitioner, however, states that as per the discharge card/summary, the surgery of the petitioner's wife was Bail Appl. No. 864/2020 Page 1 of 3

fixed for 12.05.2020. He, however, states that due to low Hemoglobin level, the surgery could not be performed on 12.05.2020 and now the surgery is scheduled for tomorrow i.e. 14.05.2020. He further states that today morning, he has sent all the relevant documents to the Ld. APP for the State through WhatsApp, regarding the next date of surgery i.e. 14.05.2020. 5.

Ld. APP for the State submits that the abovesaid documents are required to be verified and it is not possible to do so at the last moment. He further submits that as per status report filed by I.O., no date for surgery has been fixed and the application for interim bail be, therefore, dismissed.

I have considered the rival submissions. As per discharge card, the surgery of the petitioner's wife was scheduled for 12.05.2020 and according to Ld. Counsel, the surgery is now scheduled for tomorrow i.e. 14.05.2020. However, as per status report filed by I.O., no date has been fixed for surgery. The documents forwarded by Ld. Counsel for the petitioner to the Ld. APP for the State today on WhatsApp cannot be verified on such a short notice. There are serious allegations against the petitioner that he was found in possession of 23 kg and 600 grams Ganja in a plastic bag. Keeping in mind the above facts and nature of offence, no grounds for interim bail are made out. The interim bail application is, therefore, dismissed and stands disposed of accordingly.
