This petition has been filed alleging wilful disobedience of order dated 23rd October 2024, in W.P.(C) 14170/2024 by which the following directions were passed:

"1. By the present petition, the petitioner prays for a writ of mandamus directing the respondents to grant terminal posting to the petitioner either at Composite Hospital Chandigarh or at Western Command Headquarters Chandigarh. The petitioner is due to superannuate on 30.09.2026.

2. The learned counsel for the respondents, who appears on advance notice; submits that at the time of Joint Establishment Board (JEB-2024), the petitioner was not eligible for the terminal posting. Therefore, his case will only be considered in JEB-2025, which is scheduled to be conducted in January-February, 2025.

3. In view of such statement, the petition is disposed of directing the respondents to place the case of the petitioner before JEB-2025 for consideration of his prayer for terminal posting. In case the petitioner is aggrieved of the order passed by the JEB-2025, it shall be open to the petitioner to challenge the same in accordance with the law."

Counsel for the respondent appears on advance notice and states, on instructions of Mr. Devender Singh, CT (JAG), ITBP, who is present in Court, that the Junior Establishment Board (JEB) 2025 has considered the case of the petitioner and the decision is expected in 2-3 weeks. 3.

Post the decision, the issue of any consequential posting would arise, if any.

In view of the statement made by the Officer, the Court is inclined to dispose of the petition.

A copy of the decision, as and when passed, will be communicated to the petitioner forthwith.

As per the order dated 23rd October 2024, in case the petitioner is aggrieved, all remedies will be open to the petitioner to challenge in accordance with law.

Petition is disposed of, accordingly.
