The petitioner has filed the present petition, inter alia, praying that Probate Petition No.37/2018 captioned 'Sunita Sharma v. State', which is pending before the Additional District Judge-02, South East, Saket Courts Complex, New Delhi, be withdrawn to this Court. 2.

The petitioner states that the petitioner has also filed a suit being CS (OS) 233/2018 captioned 'Anita Sharma & Ors. v. Sunita Sharma' seeking partition of the property on the basis of a will dated 14.08.2010 of Late Shri Amir Singh Sharma. The Probate Petition in question also seeks probate of the said Will. It is, thus, seen that the controversy involved in the Probate Petition would also have a bearing on the suit before this Court. 3.

In view of the above, the writ petition is allowed and the Probate Petition No.37/2018 captioned 'Sunita Sharma v. State' is withdrawn to this

Court. The concerned party shall appear before the Joint Registrar (Judicial) on 30.05.2019.

The petition is disposed of.
