The instant petition has been filed seeking the following reliefs:- "a) issue a writ, order or direction to the respondents to promote the petitioners on the post of ASI alongwith batch mark. b) issue a writ of mandamus directing the respondents to pay the all consequential benefits.

c) direct the respondents to transmit all the records relating to the services of petitioners before this Hon'ble Court; d) award the costs of the writ petition in favour of the Petitioners against the respondents.

e) Pass such other and further order (s) which deem fit and proper in the facts and circumstances of this case."

Learned counsel for the Petitioners fairly states that promotion as sought for by the Petitioners has already been granted and as such nothing further survives in the present writ petition. promotion of the Petitioners should be from the date on which his batchmates have been promoted.

Learned counsel for the Union of India, states that the batchmates of the Petitioners earlier do not belong to the same category as that of the Petitioners.

Be that as it may, since the petition is being disposed of as infructuous, it is open for the petitioners to file an adequate representation, in case any other grievance survives post the disposal of the petition. 5.

Leave and liberty as sought for is granted.

It is expected that a representation, if any is filed, would be considered within a reasonable time.

The writ petition stands disposed of in the aforesaid terms.
