The present petition has been filed under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking issuance of a Writ in the nature of Habeas Corpus, directing the respondents to produce Mr. Dharmveer Sahay, the father of the petitioner and respondent no. 4. 2.

Notice is accepted by Mr. Sanjay Lao, the learned Standing Counsel for the respondent nos. 1 to 3 and by the respondent no. 4 who appears virtually.

(wrongly mentioned as respondent no. 5 in the petition) has illegally confined Mr. Dharmveer Sahay and is not letting the petitioner meet him.

The respondent no. 4, who appears virtually, submits that he has no objection with the petitioner visiting his house to meet Mr.Dharmveer Sahay; his only request is that she should come when he is also present in the house, so that there is no acrimony caused between her and his family due to her visit.

We have seen Mr.Dharmveer Sahay through video conferencing and we do not deem it appropriate to call him to Court for an interaction. Presently, as he is with the respondent no. 4, who is his son, we do not deem it appropriate to issue any further directions, except to bind the respondent no. 4 to his statement that he will allow the petitioner to visit Mr. Dharmveer Sahay and meet him in person. 7.

Such meeting should also be without the presence of the respondent no. 4 and exclusively between the petitioner and Mr.Dharmveer Sahay.

With the above directions, the petition, along with the pending application, is disposed of, leaving it open to the parties to agitate their rights for other reliefs before an appropriate court.
