By way of the present petition, the petitioner seeks quashing of the FIR bearing No. 0763/2019, registered at Police Station Rajpark, Delhi, for the commission of offences punishable under Sections 363/366/376 of the Indian Penal Code, 1860 (hereafter 'IPC'), Section 6 of the Protection of Children from Sexual Offences Act, 2012 (hereafter 'POCSO') and Section 9 of the Prohibition of Child Marriage Act, 2006 (hereafter 'PCMA') and all consequential proceedings emanating therefrom on the basis of settlement arrived at between the parties.

The petitioner and respondent no. 2 are present before this Court and have been identified by their counsel and Investigating Officer (IO) concerned, Police Station, Rajpark, Delhi.

Brief facts of the case are that on 21.10.2019, in the present FIR, the complainant had stated that he resided with his family at a rented premises situated at House No. *****, Delhi-110083, and that respondent No. 2, who was approximately 17 years of age at the time, had left the house on 20.10.2019, petitioner after returning from work and did not come back thereafter, which lead him to lodge a missing complaint. The complainant/father of respondent no. 2 had furnished the physical description of respondent No. 2 and the detail of the clothes worn by her on the date of the alleged incident. The complainant further alleged that there existed a friendship between the petitioner and respondent no. 2, and he suspected that the petitioner had taken respondent no. 2 with him by luring her and exercising undue influence. On the basis of the aforesaid allegations, the missing complaint was subsequently converted into the present FIR against the present petitioner.

It is stated that the petitioner and respondent no. 2 were in a consensual relationship prior to the alleged incident and subsequently solemnized their marriage on 17.12.2022 at Arya Samaj Mandir. It is further states that respondent no. 2 has categorically stated that she has no grievance against the petitioner and does not wish to pursue the criminal proceedings arising out of the present FIR. It is stated that the petitioner and respondent no. 2 are now living together as husband and wife and have been blessed with two children, thus leading a peaceful and settled married life. 6.

identified by the IO, has categorically stated that she has been living with the present petitioner without any pressure, coercion or threat. It is also stated that she has no objection if the present FIR is quashed. 7.

In view of the above, that the parties have amicably resolved their differences out of their own free will, and without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. 8.

Accordingly, FIR bearing No. 0763/2019, registered at Police Station Rajpark, Delhi, for the commission of offences punishable under Sections 363/366/376 of IPC, Section 6 of the POCSO and Section 9 of the PCMA and all consequential proceedings emanating therefrom are quashed. 9.

The petition stands disposed of.
