The present petition has been filed by Petitioner- Savitri@Sawatri under Article 226 of the Constitution of India, inter alia, seeking permission to participate in the survey being carried out by the Town Vending Committee (hereinafter, 'TVC') in respect of street vendors in Sarojini Nagar Market, New Delhi.

According to the Petitioner she was squatting and vending near the Police Booth, D-Avenue, Sarojini Nagar Market. On 9th September 2019, the Respondent issued a letter to the Petitioner granting permission in respect of the place of squatting of the Petitioner. Thereafter, on 3rd October 2019, the Government of National Capital Territory of Delhi Street Vendors (Protection of Livelihood and Regulation of Street Vending) Scheme 2019 was introduced wherein, surveyed persons on production of evidence of being genuinely engaged in street vending were conferred rights as vendors. The Petitioner has placed on record certain receipts to that effect. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. On 30.12.2020, the Respondent issued a Letter of Recommendation for availing Loan under PMSAVA Nidhi Scheme in respect of her place of squatting. But the same was withdrawn. Thereafter, on 30th August 2022, the Petitioner filed WP (C) 1245/2022 titled 'Shankar Lal & Ors. v. North Delhi Municipal Corporation & Anr.' wherein the TVC was directed to look into the representations of the Petitioner.

According to the Petitioner, on 2nd January 2025, the TVC survey was initiated but the Petitioner is not being allowed to participate in the same. The Petitioner submits that she has lost the original documents and lodged an FIR bearing no. 317253/2021 dated 14th April 2021, in respect of the same. 6.

The prayer in this petition is that she may be permitted to participate in the survey and Respondents be restrained from disturbing her pending the present petition.

Considering the fact that the original documents are also not available with the Petitioner, the only order that the Court is inclined to pass is that she can participate in the survey and the TVC shall take a decision in respect of her entitlement after verifying the credentials and documents if any. 8.

No other order is called for.

The writ is disposed of. All pending applications, if any, are also disposed of.
