The present application has been taken up for hearing through video conferencing.

Vide the present petition under Section 439 Cr.P.C., the petitioner who is facing trial in FIR No.218/2018 under Section 22/29 of Narcotic Drugs and Psychotropic Substance Act, 1985 and Section 63/65 of Copy Right Act seeks interim bail on medical grounds. 3.

Upon notice being issued, a status report has been filed from which it is apparent that the petitioner is getting adequate medical treatment in the jail.

After some arguments, learned counsel for the petitioner does not press the petition but prays that the Jail Authority be directed to provide the requisite medical treatment to the petitioner. 5.

Ms. Sharma, learned APP submits that the senior resident orthopaedic, who had examined the petitioner in Jail has advised that

the petitioner's x-ray be conducted and assures the Court that the same will be done at the earliest. She further assures the Court that in case the report of the petitioner's x-ray is found to be inconclusive or if the Doctors in the Jail advise any further investigation including MRI, the jail authorities will ensure that the said investigations are duly done.

The bail application is, accordingly, dismissed as not pressed. The jail authorities will, however, ensure that the x-ray of the petitioner in terms of the advice given by senior orthopaedic is done at the earliest and further medical treatment is given to the petitioner in accordance with the opinion of the Doctors in the jail. 7.
