1. Learned counsel for the Petitioner states that the refund has been received together with interest from the date of the order of assessment but not for the prior period. As regards the prior period interest, the issue is pending in the Supreme Court.

2. In that view of the matter, liberty is granted to the Petitioner to pursue its prayer for prior period interest in a separate petition depending on the outcome of the above proceedings in the Supreme Court.

3. The writ petition is disposed of.
