% 04.06.2020 (Video Conference Hearing) On 13.05.2020, the prosecution was directed to file the status report well before the adjourned date i.e. today. Today, it comes to be stated by Ms. Gupta, ld. APP that the status report was filed with the Registry yesterday at about 4:00 p.m. and a copy thereof was also sent to the Court Master through e-mail. A copy thereof has come to be put before the court today. The same be taken on record.

Heard.

It transpires from the record that an incident of rioting had taken place within the jurisdiction of P.S. New Usman Pur on 25.02.2020 and in the said incident, the chemist shop of the instant applicant was looted. For the incident relating to the shop of the applicant, the applicant lodged FIR No.107/2020 on 28.02.2020 P.S. New Usman Pur. The subject FIR No. 136/2020 dated 08.03.2020 came to be registered later on the statement of one Sh. Hari Om Sharma for his having sustained injury in the incident of

25.02.2020. As per the status report, the applicant was seen throwing a gamla (a flower pot) during the incident. As per the copy of the MLC of Lok Nayak Hospital which is sent alongwith the status report, the nature of injuries is not specifically stated. As per the copy of a certificate of MAX Healthcare, the injuries are stated to be dangerous in nature. During the course of hearing, Ms. Gupta, ld. APP concedes that the challan has since been filed and the said injured has also been discharged from the hospital. During the course of hearing, it also comes to be pointed out that the applicant has been admitted to interim bail for 45 days by the ld. ASJ on 14.05.2020.

Taking into account the totality of facts and circumstances, the applicant is admitted to bail on his executing a personal bond in the sum of Rs.20,000/- to the satisfaction of the Jail Superintendant concerned with the stipulation that a surety bond shall also be executed for the same amount within 7 days of the resumption of the regular functioning of the Courtwhich is lying suspended on account of Covid-19 pandemic, to the satisfaction of concerned Magistrate/Link Magistrate/Trial Court Application stands disposed of along with pending application(s), if any.
