According to learned counsel for the petitioner, on the last date of hearing, learned Standing Counsel for DDA had informed that the construction in question was not being raised by DDA and it was also submitted that since some other part of the property in question was in possession and control of the Revenue Authority, it must be the SDM Office responsible for raising the construction thereupon. 2.

Though, learned counsel for the petitioner states that earlier they were contemplating to implead Revenue Authority in the present writ petition but now as per the instructions, she states that in view of the above, the petition may be disposed of while granting them liberty to file appropriate petition afresh, impleading the party concerned. Ms. Manika Tripathy, learned counsel for the DDA, on instructions, confirms that DDA is not responsible for the construction in question. It is also informed that a counter-affidavit has already been filed vide diary No.5329759/24 and the above said position has been reiterated. It is also claimed that subject land belongs to GNCTD.

Learned counsel for the petitioner states that the petitioner is the owner of the land in question.

Be that as it may, without going into the aspect of ownership, in view of the above, the present petition is disposed of in terms of the statement made by learned counsel for the respondent. Liberty, as prayed, is also granted.
