The petitioner, a minority aided institution, challenges a communication of the Directorate of Education ["DoE"] dated 18.01.2025, by which certain queries have been raised, with regard to the process for recruitment of a Principal in the petitioner - Queen Mary's School ["School"]. Although it is contended that the DoE has no jurisdiction over this process, the petitioner has already replied to the communication on 22.01.2025, and has also addressed a letter dated 11.02.2025, seeking "clearance" of the DoE to conduct interviews for the post of Principal. Counsel for the petitioners, submits that the writ petition may be disposed of, with a direction that a decision be taken by DoE, within the scope of its own jurisdiction in relation to minority institutions, within a limited time frame.

Ms. Laavanya Kaushik, learned counsel for the respondents, who appears on advance notice, states that the decision will be taken within two weeks from today.

The writ petition, alongwith pending applications, is disposed of in terms of the above submissions.

It is made clear that any order passed by the DoE must be confined to the jurisdiction of the regulator in respect of minority institutions as laid down by the judgments of the Supreme Court and this Court.
