No. 23694/2015 (u/O 23 R 1 CPC filed by Objector-Sushil Behl) Vide order dated 13th February, 2001 Letters of Administration with copy of the Will annexed to the petition was granted in favour of the petitioner with regard to properties mentioned in the list (Ex. PW1/3), except the item nos. 1 and 6, subject to petitioner furnishing administrative bond of requisite value.
Later on, Mr. Sushil Bahl filed I.A. No. 1921/2003 for revocation of Letters of Administration granted to the petitioner. He claimed that he is the adopted son of Dr. Pran Nath Behl and Mrs. Marjorie Bahl but was neither made a party nor was given a notice before granting Letters of
Administration to petitioner.
By the present application, Mr. Sushil Behl seeks leave to withdraw I.A. No. 1921/2003, in view of the settlement arrived at between him and the petitioner-Mrs. Vinita Sarin vide Memorandum of Understanding dated 21st October, 2015 executed between them.
Application is supported by the affidavit of Mr. Sushil Behl, who is also present in Court today. He states that he is not pressing I.A. No. 1921/2003 in view of the settlement arrived at between him and the petitioner.
Application is allowed and I.A. No.
1921/2003 is disposed of as withdrawn.
