O R D E R

% 20.01.2016 The applicant, who is an elderly gentleman stated to be more than 77 years old, is apprehending arrest as a consequence of a non-bailable warrant issued by the concerned court in District Gorakhpur, U.P., in a complaint case instituted against him under Section 138 of the Negotiable Instruments Act, 1881 (in Short ' the Act').

It is an admitted position that the offence under Section 138 of the Act is a bailable offence.

Ms Frencesca Kapur, learned counsel appearing on behalf of the applicant undertakes that the latter shall present himself before the court of the concerned Magistrate in District Gorakhpur, U.P., which issued the subject nonbailable warrant against the applicant, on or before the returnable date fixed before the said court.

In view of the foregoing, it is considered just, necessary and expedient to direct the Delhi Police not to execute the said non-bailable warrant against the applicant without seeking prior permission of this court. With the above direction the application is disposed of. Dasti.
