The petitioner, in the instant petition has prayed for quashing of letters regarding license fee to be paid for extending contract period for milk stall, issued by the respondent No. 2 and also to set aside Clause No. 11 of the Commercial Circular No. 20 of 2017 "Catering Policy 2017" dated 27.02.2017 issued by respondent No. 3.

Learned counsel appearing for the petitioner submits that the controversy involved in the instant petition stands covered by the decision dated 30.05.2024 passed by this Court in W.P.(C) 6771/2024 titled as Ved Prakash Mishra v. UOI and Ors.

In view of the aforesaid, the Court finds it appropriate to dispose of the instant petition.

The directions passed in W.P.(C) 6771/2024 shall be made applicable mutatis mutandis. The benefit extended in paragraph No.30 of the said order shall also be applicable to the instant petition. The same is extracted below: - "30. In the circumstances, this Court finds no merit in the present petitions and the same are accordingly dismissed. However, since the petitioners have been operating these minor catering units for a significant period of time, to enable the petitioners to make a transition and make alternative vending arrangement/s, this Court considers it apposite to grant a period of 3 months to the petitioners (from the date of the extended license period after taking into account the dies non period; OR from the date of this judgment, whichever is later) to vacate the catering units in question. The same shall be subject to payment of usual license fee. It is directed accordingly." 5.
Accordingly, the petition stands disposed of alongwith the pending application.
