This is a petition under Article 227 of the Constitution of India, 1950 assailing the order dated 14.01.2026 passed by the learned District Judge-08 (Central) Tis Hazari Courts, Delhi in T.M. No.977/2016 whereby the learned Trial Court allowed two applications, one under Order VII Rule 14 of the Code of Civil Procedure, 1908 (hereinafter referred to as 'CPC') and the other under Order VI Rule 17 of the CPC seeking amendment of the plaint to the extent concerning the documents which were placed on record. 2.

The petitioner is aggrieved of the fact that the application under Section 124(1)(b)(i and ii) of the Trade Marks Act, 1999 read with Section 151 of CPC, filed on its behalf was not disposed of on the very same day. 3.

Ms. Swathi Sukumar, learned senior counsel appearing on behalf of the petitioner states that the only relief, as of today, that the petitioner seeks is that the application under Section 124 of the Trade Marks Act, 1999 may be directed to be disposed of at the earliest.

Mr. Ashok Goel, learned counsel for the respondent/plaintiff has no objection in case any such directions are passed. 5.

Learned counsel for the parties further submit that the learned Trial Court has already heard the arguments on the application under Section 124 of the Act and the matter is only listed for passing of necessary orders. 6.

In view of the aforesaid, the learned District Judge is requested to dispose of the application under Section 124 of the Trade Marks Act, 1999 within a period of 30 days from date.

The learned District Judge is also requested to recommence the cross-examination of the plaintiff's witnesses once the order on the application under Section 124 of the Trademarks Act, 1999 is finally passed. 8.

Petition is disposed of in the above terms.
