This is a petition under Section 29A (5) of the Arbitration and Conciliation Act, 1996 ('Act of 1996') seeking extension of mandate of the Sole Arbitrator w.e.f. 13.04.2025 for completion of arbitral proceedings and making of arbitral award.

It is stated in the Petition that the matter is at the stage of final arguments which are scheduled on 05.04.2025, 06.04.2025 and 07.04.2025 and is now pending for want of extension of mandate of the Arbitral Tribunal.

claimant has already concluded its opening arguments and the matter is next listed in April, 2025 for arguments of the Respondent herein. He states that therefore, the parties reasonably expect to conclude their final arguments within the next two (2) months. He states that the extension is sought to enable the conclusion of final arguments and passing of the award. He states that the extension be granted for a period of nine (9) months. 6.
Issue notice. Mr. Pranay Kishore Mishra, Advocate, learned counsel accepts notice on behalf of the Respondent. He states that he has no objection to the present petition being allowed. 7.
Learned counsel appearing on behalf of the Respondent confirms that the Respondent will conclude their submissions on the scheduled dates of hearing in April, 2025 recorded in the procedural order dated 05.03.2025 passed by the Sole Arbitrator.

Keeping in view the aforesaid submissions of the parties and having noted the previous orders of extension dated 25.03.2022, 25.04.2023 and 28.03.2024, the mandate of Arbitral Tribunal is extended for a period of 9 months w.e.f. 13.04.2025.

Having perused the previous orders and the extension already granted, the parties are directed not to seek any adjournment in the arbitral proceedings and cooperate with the arbitral tribunal in concluding the proceedings expeditiously.

The petition is allowed in the aforesaid terms. 11.
