W.P.(C) 3128/2020 & CM APPL. 10865/2020 The petition has been listed before this Bench by the Registry in view of the urgency expressed therein.

The petition has been heard by way of video conferencing. It is pertinent to mention that present public interest litigation has been filed seeking directions to the Central and State governments as well as to National Centre for Disease Control (NCDC) to adopt guidelines as mentioned by the petitioner in paragraph 12 of the present writ petition and `

to ensure strict compliance with the directions issued by the Supreme Court in W.P.(C) 10795/2020. In essence the petitioner seeks immediate framing of guidelines to protect health workers allegedly in compliance with the Supreme Court's order dated 8th April, 2020 passed in W.P. (C) 10795/2020. Upon a perusal of the orders passed in W.P.(C) 10795/2020, this Court finds that no direction has been given by the Apex Court to this Court to either execute its directions or to ensure framing of any guidelines. In fact, the present petitioner was not even a party to the W.P.(C) 10795/2020. This Court also finds that the petitioner had not filed a representation enclosing its proposed guidelines and seeking any relief from either the State or Central governments or NCDC before approaching this Court. This Court further takes judicial notice of the fact that both Central and State governments are being advised as to how to deal with the COVID19 pandemic by task forces comprising eminent doctors as well as expert bodies like ICMR.

For the aforesaid reasons, present petition and application are dismissed.
