CORAM:
HON'BLE MS. JUSTICE ANU MALHOTRA
O R D E R
% 05.06.2020 In terms of proceedings dated 28.05.2020, the status report has been submitted by the State which brings forth that the grand father of the minor child Muskan i.e. the daughter of the applicant has stated through his statement recorded to the effect that he and his wife are not in a position to look after the minor child Muskan nor is he in a position to get the minor child admitted in the school. It is brought forth through the said status report that has been submitted on behalf of the State that Muskan, the daughter of the applicant is absent since 28.12.2019. The date 28.12.2019 is the stated date of the arrest of the applicant. It is also brought forth through the statement of Mr. Umed Singh, the grand father of the minor child that the child is now living with Ms. Asha, a friend of the applicant at Narela. It is essential to observe that during the course of proceedings dated 14.05.2020, though the application itself filed was one seeking regular bail, learned counsel for the applicant has sought to press the petition only in
respect of interim bail to be granted to the applicant to enable her to make arrangements for admission of the minor child, which is also the prayer now. On a consideration of the submissions that have been made on behalf of either side as well as the status report that has been submitted on behalf of the State, it is considered appropriate, in the interest of justice, so that the minor child Muskan, the daughter of the applicant is enabled to recommence her education, that the applicant is allowed to be released on interim bail for a period of 30 days from the date of his release on submission of a bail bond for Rs.50,000/- with one surety of the like amount to the satisfaction of the Superintendent Jail, Delhi with directions that she shall surrender on the 30th day of her release before the Superintendent Jail, Delhi, shall not leave the city of Delhi; she shall make no contact with the complainant and witnesses of the prosecution;
she shall commit no offence whatsoever and she shall keep her mobile phone on at all times. The application is disposed of.
