O R D E R
% 21.05.2020 Pursuant to the proceeding dated 19.5.2020, the nominal roll has been received from the Jail Superintendent which indicates that apart from GP No.6/2018 titled as Ashok Maghnani Vs Pankaj Mehra pending against the petitioner there is no other case. It is also indicated through the nominal roll dated 20.5.2020 that has been received that the petitioner has been in custody since 2 years 5 months and 3 days and his jail conduct is satisfactory.
Learned counsel for the complainant however submits that it has been observed previously by the learned Trial Court that the applicant has been moving the applications seeking grant of interim bail for some ulterior motives.
On behalf of the State it has fairly been submitted by the learned APP for the State that in view of the minutes of the Meeting of Hon'ble High
Powered Committee of this Court dated 18.5.2020 vide Item No.6 whereby it has specifically inter alia been observed to the effect that the undertrial prisoners who are facing trial under Section 302 of the IPC and have been incarcerated for more than two years with no involvement in any other case and a good conduct report is received from the Jail Superintendent may be granted interim bail in view of the present pandemic and in view of this and in as much as the factum that the petitioner is presently lodged in Rohini Jail where 15 inmates have tested positive for Covid 19, apart from a staffer of the said jail having also tested positive for Covid 19 and in view of the High Powered Committee of this Court dated 18.5.
2020, the applicant is allowed to be released on bail for a period of 45 days from the date of his release on submitting a personal bond in the Sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the Jail Superintendent, Delhi, with directions that he shall not leave the city of Delhi, shall not tamper with the evidence and shall make no contact with the complainant and shall not commit any offence whatsoever and shall surrender before the jail authorities on the expiry of the 45th day of his release. In the event of there being any complaint or FIR or DD entry being registered against the applicant, the State shall bring it to the notice of the Court forthwith. The application is disposed of.
