Petitioner, by this application seeks extension of interim bail granted to the petitioner by order dated 14.05.2020. 3.

Learned counsel for the petitioner submits that the petitioner is an asthmatic patient and suffering from several illnesses and has also been categorised as 'High Risk Person" because of Covid-19. He submits that by order dated 14.05.2020, petitioner was granted interim bail for a period of 45 days in terms of the guidelines issued by the High Powered Committee constituted under the directions of the Supreme Court. Learned counsel for the petitioner submits that as per order dated 14.05.2020, petitioner has been directed to surrender to the concerned Superintendent, Jail on 27.06.2020. He submits that in subsequent meeting of the High Powered Committee, held on 20.06.2020, keeping in view the prevailing situation, it has been recommended that the interim bail granted to the under trial prisoners, on the basis of the criterion laid down by the High Powered Committee, be further extended for a period of 45 days from the date their earlier period of interim bail is expiring.

Learned APP for the State, under instructions, submits that petitioner has already been declared at high risk because of Covid-19, as he is suffering from several ailments.

There is no dispute that petitioner is covered by the recommendations of the High Power Committee dated 20.06.2020. Accordingly, the interim bail granted to the petitioner by order dated 14.05.2020, is extended for a further period of 45 days from 27.06.2020 on the same terms and conditions and surety.

Accordingly, petitioner is directed to surrender before the concerned Superintendent, Jail on or before 12.08.2020. 8.

Application is, accordingly, allowed in the above terms. 9.
