Present petition has been filed by the petitioner under section 439 Cr.P.C. for grant of bail in pursuance to FIR No. 40/2019 dated 13.03.2019 registered at Police Station Special Cell, Delhi. 5.

It is not in dispute that bail application of the applicant/accused has been dismissed as withdrawn vide order dated 04.05.2020 passed by learned Additional Sessions Judge, Patiala House Courts, New Delhi. The said BAIL APPLN. 899/2020 Page of 1 of 2

applicant might have withdrawn the application in the event that learned ASJ was not inclined to grant the bail. Since there is no order of sessions Court, I hereby grant liberty to the applicant to file an application within one week and the same shall be considered accordingly. 8.
