The accused/applicant seeks regular bail in case FIR No. 32/2023 of PS Ambedkar Nagar for offence under Section 20/25 NDPS Act. 2.

At the outset, learned APP for State submits that at the time of permitting withdrawal of previous bail application, this Court had granted liberty to file afresh before the trial court after examination of two witnesses who had been summoned. After examination of those two witnesses, the accused/applicant filed the bail application afresh before the trial court, but the same got dismissed in default on 01.04.2026, so the learned trial court did not have opportunity to adjudicate upon that application. 3.

Under these circumstances, learned counsel for accused/applicant seeks permission to withdraw this bail application with liberty to file afresh before the trial court.
