The accused/applicant seeks regular bail in case FIR No. 73/2025 of Police Station Crime Branch, Delhi for offence under Section 20(b) (ii)(C)/25/29 NDPS ACT & Section 345(3) BNS.

Broadly speaking, according to prosecution case on the basis of secret information, a raid was conducted on 22.03.2025 during which from the car occupied by three persons including the present accused/applicant, 119.700 kg ganja was recovered. The FSL confirmed the recovered contraband as ganja.

Learned counsel for accused/applicant submits that accused/applicant is in custody for past one year thirty one days and co-accused Akshay has already been granted bail. case, like according to the FIR, secret information was received at 01:50 pm but according to chargesheet, the secret information was received at 06:00 pm but the accused persons were apprehended at 05:30 pm. 4.
At this stage, during dictation, learned counsel for accused/applicant seeks permission to withdraw this bail application with liberty to file afresh before the trial court after examination of the relevant witnesses. 5.
As requested, the bail application is dismissed as withdrawn with liberty as sought.
