This is an Application filed on behalf of the Appellant seeking condonation of delay of 10 days in filing the present Appeal. 2.

Having heard the learned Counsel for the Parties and perused the averments made in the Application seeking condonation of delay in filing the instant Appeal, we are satisfied that the delay is sufficiently been explained.

Accordingly, the Application is allowed and the delay of 10 days in filing the present Appeal is hereby condoned. 4.

The Application stands disposed of.

After arguing at some length, the learned Counsel for the Appellant states that the Appellant may be permitted to withdraw this Appeal with some observations about the expeditious disposal of W.P.(C) 261/2026 ("Writ Petition").

She has also stated that though the learned Single Judge has provided that the Respondents shall file an undertaking on affidavit, affirming that in the event the Writ Petition succeeds, the Appellant shall be entitled to deduct the amount paid to the Respondents pursuant to the impugned award, the Appellant should also be granted a liberty to recover the amount apart from the liberty to deduct the amount in the event the Writ Petition succeeds. 8.

We, thus, dismiss the present Appeal as withdrawn. The learned Single Judge is, however, requested to expedite the proceedings of the Writ Petition and decided the same as early as possible. The Appellant shall also be at liberty to move a miscellaneous application before the learned Single Judge in the pending proceedings seeking liberty that the Appellant may be entitled to recover the amount as well apart from deducting the amount paid to the Respondents in the event the Writ Petition succeeds. 9.

We may make it clear that we have not made any observations as to the merit of the respective cases of the Parties. 10.

The present Appeal stands disposed of.
