The application is disposed of.
BAIL APPLN. 918/2020 3.
The petitioner has filed the present petition, inter alia, seeking interim bail in FIR No. 246/2014 under Section 302/34 of IPC and Section 25/27/54/59 of the Arms Act registered with P.S. Alipur, Delhi. 4.
The petitioner states that his wife is bedridden and is due for a surgical operation for replacement of her knees. He has also produced medical certificates from Indraprastha Apollo Hospital, New Delhi which indicates that she has been advised bed rest for three weeks. 5.
The status report indicates that the said surgery is an elective surgery and, therefore, it is improbable that the same would be performed considering the outbreak of Covid-19.
6.
Mr Shokhanda, learned counsel appearing for the petitioner submits
that although the surgery has been postponed, nonetheless, since the petitioner's wife is bedridden and there is no other member of the family to lookafter her, the petitioner is required to attend to her. Her p4oblem is accute since it is not possible for her to leave the residence and it is also not possible for any other person to come to her aid. 7.
It is seen that the petitioner was also released on interim bail on three prior occasions and there is no allegation that he hasdmisused the liberty. 8.
The petitioner has been in custody for over six years. 9.
In the given circumstances, it is directed that the petitioner be released on bail for a period of four weeks subject to his furnishing a personal bond in the sum of ₹5000/- to the satisfaction of the Jail Superintendent. This is also subject to the following further conditions:- (a) that the petitioner shall not directly or indirectly contact the complainant;
(b) that the petitioner shall not leave the National Capital Territory of Delhi and will confine himself to his residence;
(c) the petitioner shall not leave his residence except for medical and other essential purposes;
(d) that the petitioner shall surrender on the term of the interim bail coming to an end;
(e) that the petitioner shall provide a contact number and ensure that he is reachable at all times. 10.
The Jail Authorities shall act on the basis of this order as uploaded on the website of this Court without any further communication.
11.
The petition is disposed in the aforesaid terms. VIBHU BAKHRU, J MAY 18, 2020 pkv
