% 21.05.2020 Vide the present petition the petitioner seeks grant of interim bail for a period of four months submitting inter alia to the effect that in view of the present pandemic as there is only his mother Meena Gupta who is also unwell to look after the two year old son of the applicant, the applicant be released on interim bail.
The status report had been called for from the State. The learned APP for the State fairly submits that the enquiries conducted indicate that apart from the mother of the applicant there is no one to look after the minor child of the petitioner. The Ld.counsel for the petitioner also submits that the house of the petitioner's mother has been broken into five days ago. It is also submitted on behalf of the petitioner that the area where the petitioner's mother has been residing is a Covid affected area and thus necessarily the
petitioner's minor son is to be looked after. In the interest of justice and in view of the present pandemic situation, the applicant is allowed to be released on bail on submitting a bail bond in the sum of Rs.45,000/- with one surety in the like amount to the satisfaction of the Jail Superintendent with the conditions that he shall not leave the city of Delhi, shall not tamper with the evidence and shall make no contact with the complainant and the prosecution witness and shall not commit any offence whatsoever and shall surrender before the Jail Superintendent concerned at Delhi on the expiry of the 45th day of his release. In the event of there being any complaint or FIR or DD entry being registered against the applicant, the State shall bring it to the notice of the Court forthwith. The application is disposed of.
