BAIL APPLN.919/2020 This is a petition under Section 439 of Cr.P.C. for granting of interim bail of the petitioner for a period of four weeks on the grounds of medical ailments of his mother. As per the status report dated 05.05.2020 the mother of the accused needed coronary angiography and was to be admitted to the hospital on 05.05.2020 and the angiography was to be done on 06.05.2020, however the date is now changed to 20.05.2020. It is submitted by the learned APP for the State the accused has a married sister living with her mother at Imphal which fact is not disclosed by the petitioner in his petition. Secondly it is alleged all the borders of States are sealed and it is difficult to reach at Imphal even in case the bail is granted to the accused.

Nevertheless, the fact is 10kg. of heroine was recovered from possession of accused and he is in the judicial custody only since September, 2019. The accused is also not a permanent resident of Delhi and if granted interim bail he may never return is the apprehension of the State.

Considering the seriousness of the incident and also the fact he has a married sister and a brother in law residing in Imphal, Manipur where the treatment of his mother is going on, no interim bail can be granted at this stage.

The petition stands dismissed. Pending application(s), if any, also stands disposed of.
